Monday, April 6, 2026, in a release from Delaware County District Attorney Shawn Smith, a Delhi man was indicted on 2 additional counts, in addition to other previous counts, totaling 22 charges.

The new two count indictment against 51-year-old David W. Gensler of Delhi, New York, occurred on April 2, 2026. He was remanded without bail based on felony charges from multiple previous indictments, and will be arraigned on the new charges early next week.

According to the release from District Attorney Smith, on October 14, 2025, Gensler was indicted on 4 counts including Use of a Child Less than 17 Years of Age in a Sexual Performance, Disseminating Indecent Materials to Minors in the 1st Degree, Luring a Child into a Vehicle/Building to commit a crime, and Disseminating Indecent Materials to Minors in the 1st Degree.

Timeline And Indictments

According to District Attorney Smith, the following is the timeline and indictments:

October 30, 2025 - 4 indictments, including Rape in the 1st Degree, Stalking in the 4th Degree, Unlawful Imprisonment in the 1st Degree, and Sexual Abuse in the 1st Degree.

November 6, 2025, - 7 indictments, including False Reporting of an Incident in the 3rd Degree, Offering a False Instrument for Filing in the 1st Degree, Tampering with Physical Evidence, and Criminal Conspiracy in the 5th Degree.

February 19, 2026 - indicted on 6 charges, including Perjury in the 2nd Degree, Tampering with Physical Evidence, Offering a False instrument for Filing in the 1st Degree, Falsely Reporting an Incident in the 3rd Degree, Conspiracy in the 5th Degree, and Aggravated Harassment in the 2nd Degree.

April 2, 2026 - the 2 new indictments, including bribing a witness and criminal contempt in the 2nd degree.  It is alleged that Gensler attempted to pay a witness from a previous indictment not to testify against him in court.

In addition, it was alleged that the party had a criminal order of protection against him in place and that this contact violated the order of protection.

District Attorney Smith noted that indictments and criminal complaints are merely allegations. All defendants are presumed innocent unless proven guilty.
